Legal Overview

Wisconsin has one of the most tribal-centric gambling frameworks in the country. The Badger State has 25 tribal casinos operated by 11 federally recognized tribes — but it has no commercial casinos, no licensed online casino, no licensed online sportsbook, and no legal online poker as of 2026.

Gambling expansion in Wisconsin is complicated by a foundational political reality: any new gaming activity must be negotiated with the tribes, who hold exclusive casino gaming rights under federally recognized tribal-state compacts. Online casino legislation would require renegotiating those compacts, amending state law, and possibly navigating a constitutional referendum. None of those steps are close to completion.

Wisconsin players who want to gamble online are in a familiar position: the offshore market exists, is unregulated at the state level, and operates in a legal gray area. No Wisconsin law explicitly prohibits residents from using offshore casino sites.

What’s Legal in Wisconsin

  • Land-based casino gaming at 25 tribal casinos (Class II and Class III under IGRA and tribal-state compacts)
  • State lottery — Wisconsin Lottery; scratch tickets, draw games, Powerball, Mega Millions
  • Charitable gambling — pull-tabs, bingo, raffles under local permits
  • Daily Fantasy Sports — DraftKings and FanDuel accept Wisconsin players; no state licensing requirement
  • Horse racing — pari-mutuel wagering at licensed tracks
  • Sweepstakes casinos — social/sweepstakes platforms not explicitly banned

What’s Not Legal in Wisconsin

  • Real-money online casino gaming (no licensed operators)
  • Statewide online sports betting (no law passed)
  • Online poker (no law passed)
  • Commercial (non-tribal) land-based casinos

Regulatory Structure

The Wisconsin Division of Gaming (within the Department of Administration, DOA) oversees the state’s tribal-state gaming compacts, monitors tribal gaming for compact compliance, and administers the state’s self-exclusion program in coordination with tribal governments. The National Indian Gaming Commission (NIGC) provides federal oversight of tribal gaming. The Wisconsin Lottery operates separately.

Kenosha casino development: The Menominee Tribe signed an intergovernmental agreement with the City of Kenosha and Kenosha County in February 2024 for a Hard Rock Casino. Both the Kenosha City Council (11-6) and County Board (10-9) approved the deal. The project requires federal Bureau of Indian Affairs (BIA) approval, which was still pending as of May 2026.

Sports Betting in Wisconsin

Online sports betting is not legal in Wisconsin as of May 2026. No statewide sports betting law has passed the legislature. Bills have been proposed but have not advanced to a floor vote. The same tribal exclusivity concerns that complicate iGaming apply here — tribes want to be the sole authorized operators, and no legislative consensus has emerged.

Daily Fantasy Sports (DFS) in Wisconsin

DraftKings and FanDuel both accept Wisconsin players for daily fantasy sports contests. Wisconsin has no explicit DFS statute — the operators function without a state license requirement. No state authority has moved to ban DFS in Wisconsin. Minimum age: 18 (operator-enforced).
