Legal Overview
West Virginia is one of the most open online gambling markets in the United States. The Mountain State moved faster than almost any other state to legalize iGaming: Governor Jim Justice signed the West Virginia Lottery Interactive Wagering Act (HB 2934) in March 2019, making West Virginia the fifth state in the country to authorize online casino gaming and online poker. The first real-money online casino — DraftKings Casino WV — went live on July 15, 2020. As of May 2026, more than 10 licensed online casino brands operate in West Virginia, all regulated by the West Virginia Lottery Commission.
Sports betting followed an even earlier path. West Virginia authorized sports wagering in March 2018 — before the Supreme Court’s PASPA decision — and became one of the first states in the country to have legal sports betting. Eight online sportsbooks now operate in West Virginia.

Regulatory Structure
