Legal Overview
Florida has one of the most complex gambling landscapes in the United States. The state has a large network of tribal casinos (Seminole Tribe), dozens of pari-mutuel facilities, and a state lottery. Online sports betting launched in late 2021, was shut down by a federal court ruling in December 2021, and relaunched in December 2023 after an appellate court upheld the compact. As of 2026, Florida has legal sports betting — but only through the Seminole Tribe’s Hard Rock Bet app. Online casino games and online poker remain off the table.
What’s Legal
Online sports betting is legal in Florida, but is available exclusively through the Hard Rock Bet app, operated by the Seminole Tribe of Florida under a 30-year exclusive gaming compact with the state.
Governor Ron DeSantis signed the gaming compact (SB 2A) in April 2021. The Florida Legislature approved it in May 2021. The Hard Rock Bet app initially launched in November 2021, but was shut down weeks later following a federal district court ruling that found the compact violated federal law. On June 30, 2023, the U.S. Court of Appeals for the D.C. Circuit reversed that decision and upheld the compact. Hard Rock Bet relaunched statewide on December 5, 2023, and has operated continuously since.
No competing online sportsbooks are permitted in Florida. FanDuel, DraftKings, BetMGM, and other multi-state operators are not licensed to offer online sports betting in the state.
Daily Fantasy Sports (DFS) exist in a legal gray area in Florida. No statute explicitly legalizes or bans DFS. Major platforms including DraftKings and FanDuel operate without express statutory authorization. Players must be 18 or older.
The Florida Lottery has operated since 1988. Players must be 18 or older.
Land-based casino gambling is legal at tribal casinos (Seminole Tribe), pari-mutuel wagering facilities with card rooms, and licensed slot machine facilities.
What’s Not Legal
Florida does not currently permit online casino games. No legislation authorizing regulated online slots, table games, or other casino-style internet gaming has been enacted or seriously advanced in the 2025 or 2026 legislative sessions.
Online poker is not legal in Florida. Florida is not a member of the Multi-State Internet Gaming Agreement (MSIGA).

Regulatory Structure
The Florida Gaming Control Commission (FGCC) is the primary state regulator for non-tribal gaming. Established under Chapter 2021-269, Laws of Florida, it is a five-member body within the Office of the Attorney General. The FGCC oversees pari-mutuel wagering, card rooms, slot facilities, gaming compact compliance, and licensing.
The Seminole Tribe of Florida self-regulates its tribal gaming operations under its federal compact, overseen at the federal level by the National Indian Gaming Commission (NIGC). The Florida Lottery is overseen separately by the Department of the Lottery.

Pari-Mutuel Facilities and Card Rooms
Florida has an extensive network of pari-mutuel wagering facilities (horse racing, jai alai) regulated by the FGCC. Many facilities are licensed to operate card rooms (poker only) and/or slot machines. The number of active facilities has declined since Amendment 13 ended live greyhound racing effective January 1, 2021.
